Tort of Liable.......Has anyone ever dealt with this issue?

    I would like to know if any lawyers here or anybody else has dealt with somebody who is posting messages on the internet to others that have caused you to suffer financially?

    Did you pursue taking action against them?

    How and did it work?

    It depends.

    If they post their opinion of you then they are entitled to that.

    If they post falsehoods as facts then thats slander.

    Speak to a lawyer.

    It is very hard to do. Unless you suffered a very large loss financially (in excess of $100,000) it would almost never be worth pursuing.

    That is from my experience.


    Slander is spoken, libel is written. Since this was posted (written online), it would be libel not slander.

    Hi,

    I think that if you believe you've been libeled, then I would get a lawyer to send a written warning immediately, especially if you know how to get in touch with the person. It won't cost that much, and it would show that you are serious.

    I know that since it is libel and not slander I need not prove special damages, just general damages, and I do in fact have proof of that.

    So as far as the damages being $100,000 or more that can be applied to this situation since it is general and not special....
