I don't know the laws of US. But torrent is the name of technology . As I know, there are many opensource torrent project in sorceforge dot net . And skype use the torrent technology to transfer voip data . Why torrent site is illegal , I can't understand !
Torrent isnt illegal infact i think linux also uses torrent technology... But torrents are bieng used mainly for movies and stuff so therefore was refering to that part
Torrent itself isn't illegal.. its people who share copyright materials and makeit illegal. and Yes you can Share NON Copyrighted Material through Torrents.. Few Singers released their albums exclusively on Few Torrent Sites in Past.

Alot of trackers are still based in the US and live off the "None of the files are hosted here" Stand point but that usually breaks down once the MPAA gets after you. Best thing to do is really go offshore in a country that will allow it (sweden, amsterdam) or don't start one at all.

However, the torrent tracker must be DMCA (Digital Millennium Copyright Act) compliant. Let me give you an example of DMCA compliance. You must provide a contact email address that a copyright complaint can be filed through somewhere on your site. This can be something like or whatever you choose. If a copyrighted file is shared and the copyright holder finds out, they can't sue you. They must first send an email to the DMCA address you specified with proof that they own the copyright and links to the infringing file on your site. You must remove it within a few days or else they might be able to take further action. I can't remember the exact deadline.
