'torrents' in itself pretty much symbolizes illegal, however it depends on what your torrents consist of and based on how torrents are used today i am guessing illegal.

All you really need to do is say that you collect nothing from donations that all of them go towards servers and running costs and you'll be safe. Make sure to go with a safe haven country like Holland.

In the US offering and hosting torrent files (as it pertains to sharing and distributing files and software of copy written materials that you do not own, or have the rights to distribute or provide access to) is illegal. Everything connected with it is illegal as well in the U.S. Should be clear enough. I can't speak to what happens in other countries that don't respect copyright.
