    The contents which your members upload to your site/server could be considered as part of your contents.

    If the copyright owners or the law enforcement agency finds out about copyrighted contents or undesirable contents, they could issue a court order or cease or desist letter to you for you to take down or go to court to answer the charges.

    What's on your server can be treated as your contents and especially so if there is no way to track down the person who upload them anyways.

    Remember that the higher the level of traffic and visitors, it would mean higher the cost of running the free file host. And it would also mean that you will have more work to do to enforce that no copyright or undesirable contents are on your site. You need to be proactive. Make sure that when you run a free file host that you have the finances to run it, assume no income because advertisement income is not constant or assured.
