Times Online Breaking Google TOS?

Has anyone else else noticed this

When you click on an advert on any article on the times

It launches the site in a new window.

(Please note i am NOT trying to boost Mr Murdochs turnover)

Isn't this against the TOS or do big players get a special arrangement with google.

NY times has preferential treatment as well

Does this only apply to the newspapers?
