If he got rid of the tag "or try this"
    He would be okay.

And the site is fixed. That is one more quality sites for Google Adsense. Good Job "the webmaster" you have restored my faith in the DP forums. Now that we spent 60 posts talking about this one site perhaps next time we can fix the problem much quicker.

I hope that all those who were quick to rush to judgment now take some time to rethink reporting someone. ;)

If someone steals a product from a supermarket, and after some time, comes back and pays for it, does that make it ok ?

    No

Yes but if that person accidentally(absent mindedly) walks outside of the supermarket without paying then realizes what he did and returns to pay for it I would say it is perfectly ok. In fact it happens all the time people rush back in red in the face and humiliated with what they just did. But in a world of FAST and OVERWHELMING people seem to overlook the SIMPLE stuff that we should not overlook.

The fault in your logic is the first example is a person who knew he/she was doing something wrong prior to walking outside with the stolen item.

We can use lots of analogies but with most american laws and contracts it requires intent to break such a contract. There are hundreds of people out there at this very moment breaking the contract on purpose. There are still rules and regulations that Google lays out that many people when signing up for Adsense do not agree to but have to learn about at a later time. Therefore if they keep the site unchanged after LEARNING then they are obviously doing something wrong - but not until.

As a publisher it is up to each of us to know the TOS better than the back of our own hand - if we dont know the TOS and make a mistake in breaking it then its our own hard luck.

He clearly broke a rule that even a child could see and understand, he is an experienced webmaster (as I stated) so he knew exactly what he was doing.

Well, You guyz are surely mistaking actions of google.
If a site is violating TOS, and you report the site to google, they just dont rush to ban the site right away.
They investigate, and often send a warning/notice email to the owner of the site. Myself got notices from google a couple of time, although it wasnt a TOS violation, but some guideline and layout issue. but I know few people, who got warnings from google, b'coz they were violating TOS in some way.
They fixed it, and they are fine.

At this Point we should place an explanation of the original situation.

At the end of every thread, the forum was displaying an adsense ad. There is ABSOLUTELY nothing wrong with this practice (provided all the basic T&C are abided by. The issue was that the webmaster had the words 'OR TRY THIS' Above the adsense ad.

This was clearly a breach of the T&C of adsense as it was drawing attention to, AND encouraging people to click on the advert.

Hopefully this will help the thread along in the right direction.

Oh but it is the same my friend.

You steal an advertiser's money. You actually point users to click on ads (and on many ocasions users are loyal), that they themselves should decide to click or not.

I'm sick and tired of this webmaster redemption issue.

After some time, 80% of them start doing it again.

There are black hats not only in seo, but in a general way of the web.

PS: I'm not saying that you will do this again.

    Cheers.
