This guy is setting me up for a possible suit, what can I do?

    Hi all,
    I am an online ecommerce website owner and this one customer wanted to return an item back for which i generated a RMA # and sent it to him to send me the return item.

    This Pr** sent me the same boxes I sent him but with paper and not the item I sent him. He sent it via ups and tracking # paid $ 20 + $20.xx for two separate boxes.

    Now, can he sue me after 3 months for not giving him a refund and how can i prove that he indeed sent me crap instead of the goods I sent him.

    I called him and told him abt it but I have not send him in writing about this matter just to have a proof to let someone know that the item shipped was not what I sent him. When I called him he tried to tell me that i was lying and then he said he was going to check with the post office. Never heard a word again ....

    When you send a package, many times it is weighed to get accurate postage on it since packages are transported on planes and trucks that have weight restrictions, and they have to be accurate when loading them.

    If you have the paper work that accompanied the package, contact the shipping company and see if you can get the weight of the package that was recorded when it was dropped off, and then compare that to the actual weight of the boxes with real product in it, and also fill your own box with the same kind of paper to get a match.

    That should prove your case well enough.

    People will threaten to sue all the time. I get threats monthly from one of my sites. I would take it as a grain of salt. We are talking less than $100. It would cost the guy way more than what it's worth. However, I would investigate it just to be safe.

    I am curious how you know the amount in question when it was never mentioned? The poster only mentioned the cost of the return shipping to him from the customer.

    Nice advice!, That is exactly what i told that Moron when i called him, I said the weight don't match up and he backed out saying that he is going to check with his postal company (like he owns it) .

    Anyways, the pack i sent him was one of those priority mail things where they ship the pack no matter what weight it is, but the pack i got from him has a tracking #. If push comes to shove, I think I can use it to obtain the weight inforamtion, am I right or wrong?

    even with priority they still do measure the weight even though they dont charge by weight. the receipt they gave him will have the weight of the package listed along with the other details, so he should have that receipt and should be able to scan and send that as proof and then you'll see the weight on that. ive shipped priority plenty of times and am pretty sure the weight is listed on the receipt.

    I dont think if he will ever sue you. You were judicious if whatever you are saying is true. Actually the person tried to get rid of you. Do you have received a note or something that alamrs you about impending danger?

    Listen, You are the business owner - therby wrong by default. Give the man the refund and move on. Let's say there is a 1% chance he is telling the truth, he is going to be running your business in the ground on every forum and blog on the internet. Even if he is scamming you, he may be doing the same thing! Bad PR in an already competitive retail environment is not worth losing a few bucks on a bad deal - just dont ever do business with him, that address, that phone number etc again. If he tells his scandalous friends the trick, call BS the second or third time and you wont suffer any negative PR. I know you can get worked up about somebody blantently screwing you, but its not worth the elevated blood pressure to have an argument go that far with a customer. Dealing with this is preventing you from making money because of opportunity costs associated with what your not doing. There is no argument for principal's sake in business, it is for revenues sake; and what you doing based on principle is only hurting you. ALWAYS assume the guy that is calling in the complaint is recording your call and has the "in your corner" consumer news guy on speed dial waiting for you to screw up...
