Theft by selling LINKS!

I had a deal for link trade with a guy on this forum. His nickname is stdio and he goes with Scott as I could get from paypal his real name is: Marin Micoriciu (email: ) assumingly from Romania.
    Original registrar for hostingzero.com:

    Fax: 305-946-3116
4608 Waterfall CT Owings Mills, MD 21117 US

I paid $350 for lifetime link on his website (www.hostingzero.com) using Paypal. Then he closed his website. I sent him messages from digitalpoint and he read the first one. He even tried to sell me a link on another website. Thank God, I didn't find the offer reasonable at that time.

I contacted with PayPal and opened a dispute. Their response was, they can not do anything after 45 days (WHICH IS RIDICILUOUS)

As a result, I lost my trust in this forum and paypal. Although we are relying on paypal, when it comes to dispute, the link sales is not considered as 'service', not considered as 'product' or anything.

I don't think I can do much about this now rather then warning you for this kind of guys on this forum. They are not living in USA so they do not have any reason to keep their promise except they have good heart. Having lots of Trader is not very reliable as you can see in this case (he had 35)

Hm, Googling his name only finds him as a p2p forum member - says it all? Perhaps contact the server administrator given in the whois?

I would take a guess and say he sold the domain, or pushed it to a 'friend'. When exactly did you buy the link?

Hi Spider-man, this person (Marin Micoriciu) is already receiving my emails. He is aware of this situation, I tried to contact with other addresses but it is failing. I'll try sending one more email. Thanks for your input.

I hate to tell you but I think you are just out of luck.

    You bought a lifetime link.
You say he closed the site.

Well, that seems to be the end of your deal. Unless he promised to keep the site online for some length of time, your contract would not force him to keep his site open forever. The deal requires him to leave your link on for the lifetime of the site. No site, no link.

Personally, I think 'lifetime links' is a misnomer. There really is no way to realistically enforce that type of deal - so it does not exist. I have bought some lifetime links. To be honest, I am surprised they are still up after two years. Some people are honest. However, I don't dare think the guy I paid a couple bucks to has some obligation to keep his site up forever. When he shuts down, that is it. I do expect my links to stay up as long as he owns the site.

So are you saying the e-mail given in the whois, as well as the contact details, are false? And that this 'Marin' guy has registered it in the name and address of Bogdan Ionita? If so, you can bring this to the attention of eBay, as you have been a victim of fraud, as this it is against the law to register a .com domain with falsified details. Whether or not that'll stand up in the courts of Romania, I don't know. I'm not sure what country you're from, and can't really be bothered looking to find out, but the best advice I can give is to either call the guy, or ask someone who works in a UK supermarket to pass on a message, as I'm sure there's no longer a supermarket in this country without any Romanian workers:eek: Anyway, good luck with that!

Next time make sure you define 'lifetime' when making a contract with someone. I think you need to chalk this one up as a lesson learned.

Agree, would need to see the contract (assuming there is one) but first assumption is that lifetime is the lifetime of the website not of you personally.

Your contract should have had clauses on minimum term such that if the life of the website was less than this you could recoup some of your monies. Of cause if he has gone bust you would just be another creditor fighting over the corpse.

Guys, I really appreacite your responses on this matter. I had a message from a person I mentioned in this thread (domain's original owner). He was the first owner of this domain and he has nothing to do with Marin Micoriciu so I'll ask forum moderators to remove this whole topic since they can not edit my original post.

I'll open a new topic on this. I want this name "Marin Micoriciu" to be found on internet under this topic. At least other people who would have any business with this guy will see his/her real face.

As I discussed with forum moderators, the forum policies do not allow a post to be deleted nor modified.

So it seems, the only option I have is to apologize from Imad Aloyoun for mentioning his name in this thread. He does not have anything to do with this domain since it was dropped in 2004 and re-purchased by the current owners.

I don't think you can do anything about it.
It sounds like theft to me though.

Unless there is a proper contract detailing the conditions etc, then this is a case of bad luck for mazter and bad pr for the link seller.

By the time you have argued with ebay etc and the time spent venting frustration about it, you will have spent thousands of dollars of lost time.

Mazter, you should add the $350 to the "lessons in life" account. We all contribute to that account very often.

craigedmonds, I did not have that account till I hit that guy, so I guess, I am one of us now :) but I got my lesson, trusting people based on iTrader isn't the way to make deals on this forum. Especially if it is > $xxx,xx range. I don't want to sound like, don't trust anyone. I have good examples as well. I dealt with a honest guy (<18 years old) for $1,000 and he did everything as he promised. I guess, life... ;)

ya unless you guys had something specific on how long the "lifetime" link was for I'd chalk it up to a good learning experience.

    Sorry for your luck
