    Yes they can be, as long as they're not used descriptively.

    Here's a fun example: go to uspto.gov and search for serial numbers 75621859
    and 76680902. See what they're each using it for, even though it's the exact
    same word.

    Anyway, the application's being opposed. Highly unlikely the application will be
    granted, especially if someone's up to showing potential fraud on the part of
    its applicant.

    No, updates, However is the trademark on the SEO or Search Engine Optimizing/er or even all or none of the previous. Regardless only a really big fish with the firm and the government connection to back it would be able to enforce or even handle the lawsuits, that may come to make such a weak trademark effective, who is to say that out of 100 people that the majority would recognize SEO as synonymous with the specific process outlined by the trademark holder in question. McDonald's Golden arches and name, which are weak trademarks only work because by far a majority of persons synonymously identify the product; the service with the trademark and trademark holder, if your really concern don't try and help him by making more people aware of and associate his process with the term SEO:confused:
