These statements are absolutely false. Sunrider has prevailed in court against individuals making these ludicrous claims, and Sunrider will pursue all available legal remedies against those who continue to spread false rumors about Sunrider or its products. As set forth in detail below, the lab report claiming that Beauty Pearl® contains human DNA has been thoroughly repudiated. Furthermore, both the Supreme Court of British Columbia and Health Canada (the Canadian equivalent of the United States Food and Drug Administration) have reviewed the facts and concluded that Beauty Pearl® contains no human DNA and poses no risk to human health. 1. The laboratory report purporting to show that Beauty Pearl® contains human DNA is unreliable and without merit. A subsequent analysis performed by the same laboratory proves that Beauty Pearl® contains no human DNA. The individuals who claim that Sunrider’s Beauty Pearl® contains human DNA rely on a dubious lab report that has been discredited by the Supreme Court of British Columbia." This lab report from the British Columbia Institute of Technology concludes that an unidentified substance of unknown origin contains male and female human DNA. The lab report does not even identify Beauty Pearl® on the report. The scientist who performed the analysis candidly admitted to Sunrider’s attorney that he had no opinion about whether the samples were Beauty Pearl® or otherwise had any connection at all to Sunrider. Indeed, the lab report states merely that the scientist received “one container with 10 pills.†There is no evidence that the container, or its contents, were manufactured or distributed by Sunrider. Convinced that Beauty Pearl® contains no human DNA, Sunrider arranged for the same scientist at the British Columbia Institute of Technology to test actual samples of Beauty Pearl® under controlled conditions in 2007. Sunrider Canada’s manager brought two sealed, shrink-wrapped, and unexpired packages of Beauty Pearl® directly from Sunrider Canada’s warehouse to the lab. As expected, the samples tested negative for human DNA. 2. The Supreme Court of British Columbia ruled that complaints regarding Beauty Pearl® are defamatory and without merit. In 2007, Sunrider brought a lawsuit in the Supreme Court of British Columbia against an individual who claimed on various Internet sites that Beauty Pearl® contained human DNA and was unsafe for human consumption. The defendant also claimed that Beauty Pearl® caused him to suffer serious illness. The court ruled in favor of Sunrider and concluded that the defendant’s allegations against Sunrider were false and defamatory. For reasons stated above, the court disregarded and discredited the British Columbia Institute of Technology laboratory report submitted by the defendant which concluded that an unidentified substance of unknown origin contains male and female human DNA. This same discredited lab report is still relied upon by others who falsely continue to allege on the Internet that Beauty Pearl® contains human DNA. After various hearings at which the defendant was given ample opportunity to present his case, the court ruled in Sunrider’s favor by granting a permanent injunction against the defendant, and ordering him to pay Sunrider’s legal costs. 3. Health Canada investigated the safety of Beauty Pearl® in 2006 and concluded the product presents no risk to human health. The same individuals who have posted defamatory allegations about Beauty Pearl® on the Internet brought their claims to Health Canada in 2006. Health Canada conducted a thorough investigation, which consisted of a visit to Sunrider Canada’s office in British Columbia to interview management and collect product samples, followed by Health Canada’s own laboratory analysis of Beauty Pearl®. Upon conclusion of its investigation, Health Canada determined without reservation that Beauty Pearl® presents absolutely no risk to human health. 4. Conclusion The foregoing facts establish that the allegations currently circulating on the Internet regarding Beauty Pearl® are neither accurate nor reliable given the overwhelming evidence that Beauty Pearl® is a safe and sanitary natural health product.
