The best idea

    Hello,

New fella here. Great forums and I have no idea why I didnt join sooner? Nice to meet you all.

Im trying to figure out what the best idea would be for the following situation.

I live in Canada and have recently aquired a few .ca domain names that are offset from pre-established .com names (im not sure if I should list them cause they are parked and I dont want to bend any rules).

So, i will list the categories:

    - Music -- a few genre .ca domains and 1 big name band .ca domain

    - Identity Theft Protection -- I impulse purchased the .ca of a site that advertises on TV.

Are there any "general rules" for this type of thing and .ca .net etc knock-offs? Again, Im trying to figure out what the best and most profitable way to go might be for this type of thing.

If anyone can post a suggestion or two so that I can get some brainstorming help that would be great.

    cheers

You better make sure that those domains you got donot have any .coms owned by registered companies already. If that is the case, I am sorry to say, your domains would be worthless especially if they share the exact same name. You cannot develop them, you cannot do anything in that case. On the otherhand, if its just a part or partial of the name, you may like wise open something related to the actual thing, like a fan site or something.

oh wow, thats not good

Is there a way to find out if they are registered?

What if I just park it?
    Or
set up a Tribute/fan/Info type site?

Thanks for your post, most eye opening! I though domain names were free for all???

    Check it on Who.is

You need to know the domain whereabouts, else you can have legal actions implemented on you. Its no longer a Get it when you can thing.

That would be nice if they "sent a letter" first.

Ok, I may as well name them. Just add the (dot)see a -- to them..

    - The first is my "Jamiroquai" one. Im pretty sure they are handled by Sony :( As you can tell by my avtar - Im a fan. The idea was to post articles and band info and use Adsense and/or affiliate downloads/cd/dvd sales.
    What do you think?

    - The 2nd is "acidjazz" (dot)see a -- The .com is owned by AcidJazz Record Label. However, there cant be any trademarks on a "genre" of music. So, I think Im safe with this one. The only thing is, Im not exactly sure what the best thing to do with the site is. Im a musician and huge acidjazz fan but, still cant come up with any ideas to make money with it. I think Im gonna post for ideas or default to the obvious affiliate cd/dvd etc sales

    - The 3rd "ProtectMyID" (dot)see a -- was an impulse buy for two reasons. 1) I saw the tv add for the .com on spike TV while watching UFC
    2) I knew the Adsense Ad's have Juicy payouts for the related keywords.
So I checked for the .ca and it was availible. I thought CHA CHING -- until I saw your post.

So what do you think? What are my options? How do I "officially" check to see if Im gonna be "raped" by these guys?

And most of all... If these things are trademarked and Im breaking the "law". Then why the hell is it so easy for me to buy them?

Well thats the point :) No one else buys them. That is You can find trademark domains very easily.

Well I'd say you write a mail to these guys, like most DP members here. And inquire about the usage turmoil they are willing to offer you. The thing is, you can't even sell these domains if they are trademarks already. So thats the only option you are left with.

    Ya,

I think I will email them and see what they say.

What do you think about the acidjazz site.....

My thinking is... If I dont add anything that has the "acidJazz" record label on it, I will be safe.

IMHO. Contact all Trademark owners. That would be your only safe passage.

    Xavier is correct.
But, most likely they will not bother with you, or even find you unless you start invading their territory on Google.
Then you will receive a letter that insists that you turn over the domains to them.
You counter with a letter to sell the domains to them to cover your expenses. If the price isn't unreasonable it is cheaper for them to buy them from you than to pay a lawyer to fight you.
At least that is what I have experienced.

    Good Luck!
