Terms of service on my site...

    I hadn't thought much about a terms of service for my business, but I am thinking that I should have one. Mainly to inform my clients that until services are paid for, I own copyrights. This has come up because a client received twelve articles and is using them, but I haven't been paid and no replies are forth coming.

    My main question is:

    If I add a terms page to my website, is it legally binding?

    My underlying question is:

    Do you have any suggestions on what I should include in my terms if one is deemed necessary?

    It might be.

    For what you are trying to do I would think a checkbox confirmation on the order form is a better approach.

    Then, yes I think it would be binding but is it really worth the effort to enforce?

    Actually the TOS is not much help.
    Your client can still use the article without paying you in full.
    So you should seek other solution to tackle this problem such as force your client to pay in full before you giving the article to them.
