Sue Hosting Company - Help

    Hi,

    The site was doing well adding 100 videos a day totaling 20000 videos and 10000 users.
    The site is 2 years old.

    3 days back my site was not opening and contacted Apt who said there was a problem with server and it would be rectified soon.
    Then after a few hours they said the account was cancelled and that the dedicated box was cleaned and made ready for another customer.
    All this done without intimation and now I don’t have a site or backup as I used to take a backup every 2 months.
    Now left with nothing 2 years of hard work down the drain.

    Apt says they rec, intimation from Google Checkout for cancellation as the automatic was not paid however I paid for that from the credit in my account.

    After this they refunded the amount of 219 due every month. If they say canceled due to nonpayment my Google why the refund
    also the invoice was for 149 whereas my service was 219.

    Now today again I get an invoice and payments taken for sever which is cancelled 6 months back.

    I want to sue them as I have no site now no videos no users they say nothing can be done that all.

    no case...backups are your own sole responsiblity...seeing that you have nothing,
    i suppose you have no proof either since it is all gone...this brings up another
    issue, whos videos? if you did not make them, then they were not yours to begin with.

    as with your other problems, thats between you and them, no case will ever be made of it.

    read the hosting company TOS, i think its your duty to backup ur data daily and prepare for the rainy days.

    Usally a host makes a daily or weekly backup of your site. Ask them for that backup, they might charge you for it though.

    Sorry to hear your story. You would expect a good host to backups daily to tape or off site weekly and store monthly. They might not do it for your site given the amount of videos.

    I think that you would not win in court, so I advise getting a new host ASAP - keeping the domain live and re-populating as soon as possible.
