Yeah it's unfortunate. Has happened to me before especially people who use ebay and such. People need to get more original or do their own work.
Basically (as stated earlier): the guy hasn't done anything wrong. He saw your idea, and since you haven't trademarked your website - he is doing legally fine. What you could do is to trademark your own site (mysticky) and if the other guy makes millions with his website (which I doubt), then at that point you can simply sue him for "trademark infliction". (I'm not a lawyer, but Technically that could work - ask somebody who is a lawyer for guidance). Actually, your idea is not that new. Even I got that idea once (never seen your site) but didn't have interest to proceed with it. I think you are worrying too much: it's not about the idea alone. It's how you market it. The other guy might be a copycat who just put google ads on his site and hopes for the best. If you can outdo him (and rest of the competition who also have that same idea), then focus on that. Fight in the field of server capacity and marketing are eventually the stuff you really need to concentrate on - not fight in court. (And if you want to prepare for the court too... you could patent & trademark your idea...) I really wouldn't worry if I were you. Let the copycat clone: that's a sign that you have something good in your hands.
No that would not work now because even if he did trademark it, because the other site was created before the trademark was created there is nothing he can do. In a legal sense Hecky cannot do anything because the other site is already created and hecky did not copyright or trademark it so even if he does do it now its too late to do anything to mystickyz.com, but if anyone else used his name maybe he could do something. Also I also think Hecky should concentrate on improving his site otherwise mystickyz.com will win simply because it is better at the moment and he has the advantage of a .com domain Thanks
I'm not 100% sure how trademark laws are working (I'm not a lawyer), but I believe one can trademark his system "based on history". Basically that means that if somebody can show that he has "used the mark a long time", it's possible for him to trademark it and kind of like "show that I already had trademark, even though I didn't register it". (but by all means: ask lawyers help, all what I said here can be taken as a grain of salt ) Anyways - like I said: it's better to take the battle to the marketing, than in the courts True.
Hecky, pretty original stuff with the sticky. It will definitely catch on, as other forum members had already used both sticky sites to reply to this tread. How awesome is that! Here is some advice, Remove the ads. Build traffic, user base, backlinks. Leverage website traffic for CPM deals. Develop more content around the concept. Keep promoting. FIling a patent application would cost much more than the $200 he paid to have the site built though..... Where does he make out he is a bigshot?
Without a copyright or patent theres pretty much nothing you can do. Ideas are mostly free to steal without patents, ie How many ecommerce sites can you name? What you'll have to do is just out promote him, you probably have less money but are smarter than him and I'm sure you can figure out some good cheap/free promotion ideas. Good luck
