I don't think there would be a problem as long as all your videos have models above the age of 18 or legal adult age in their country. Their are a lot of porno streaming sites so it might be hard to expose but with time and good seo optimization you probably would get good traffic.

Wouldn't there be a content problem? Can you take other videos that aren't yours and put them on your site?

Wouldn't the people who produced those videos come after your ass?

You can use any content you do not own without express permission.

I'm doing thinking about this and they have to be illegal?

I've seen movie sites that do streaming movies on them and they always get shut down...

Same concept about a porn video on a site...

Are the servers not in the USA?

If you don't have permission, it is illegal no matter where you host. Offshore hosting makes it harder because DMCA is a US law, so they have to sue you. You can look at the recent judgments against PirateBay, Mininova, Rapidshare to see the millions of dollars in fines you could be facing. The net used to be the wild west, but it is quickly changing. You need to hire an attorney if you want to proceed. Where you live also factors in - and if it in the US, you shouldn't even think twice about doing it. You are stealing content, and the owners might just decide to sue you and then you are looking at hundreds of thousands of dollars in legal fees to defend yourself. Copyright infringement can also be criminal, and people have gone to prison in extreme cases. It's something that you really need to think about before you subject yourself to a potential huge liability that can follow you for life even if you don't currently have any assets worth taking.

What mjewel is saying is right. If content is illegal in one country, most likely you will receive a DMCA letter. The only reason why people host on "offshore" servers is to make it harder for their country law makers shut down their site.

Wiki Internet Porn - Decent information

Other then that, most streaming sites have a partnership deal on how if their video is being played their AD is being shown at the same time.(Xvideos does that now) You might need to research a bit more on this as their is limited sources on the internet.

    Don't you mean:

You can't use any content you do not own without express permission.

I assume it was just a typo on your part?

Are you serious? Let me give you some advice. mjewel seems to know what he's talking about when it comes to legal matters - so generally just listen to him. Also, any moderately intelligent human being knows you can't just steal media from one website (especially an adult site) and post it on your own site and claim to be doing nothing wrong.

Please stop posting in the "Legal Issues" section when you clearly have no idea about anything related to legal matters.

Okay this is just assuming that you are hosting full, unlicensed movies. There are a few factors which decide whether it is legal or not.

The first is if you become an affiliate of a few porn company's they will give you lots of clips to advertise their sites. Bare in mind they may only be 3-5minutes long, it's still content. I actually think I've heard of some affiliate's using a script to post to your "tube-like" site.

The second is who is uploading the content? If it's members who are supposed to be uploading their amateur content, and they let slip some unlicensed material, how is yourself (one person presumably with a full time job) supposed to moderate every upload. Just make sure the majority is afflicted stuff. (This is NOT legal advise)

Third is you can always contact members who upload on other sites and ask them if they would mind posting on your site. You won't necessarily have to pay them if you offer them free access to your "exclusive VIP section" of your site.

Fourth is just be courteous. If a content owner contacts you asking you to take down content, just do it and comply with what they say, and send them an apology email. Even try striking a deal with the company to see if you can use some of their content to bring some traffic to their site.

Go for an offshore hosting provider which generally avoids legal complaints and then it did be fine ,

You better get off-shore hosting to be certain. US laws may trouble you :)
