My site was stolen, but just the layout not the images, It looks exactly like my page except they edited my images to make them look new. Their content is also stolen from another popular site, but just changed and edited to make it relevant to his site. What Can I do? Are you allowed to steal layouts? They also stolen my title. Ex: Lose Weight Now His is Burn Weight Now. He's a web merchant, should I report his site to his affiliate network or host? Should I just move on, or take action.

Unless its an exact match, you will have a tough time getting him banned.

Unless he copied your source code, yeah, it is probably legal.

I doubt source code is what the case would turn on.

I don't think there are many ultra unique layouts out there and it would be hard to prove that he did not have the same design in mind. If he just makes a few boxes 1px smaller or larger then how can you prove anything?

Good point. I suppose it would depend on the specific nature of the layout.

if he only copy your layout, copy another site's contents, and change here and there something, it is really hard to say who will win.

There also seems to be so many generic layouts/templates/css designs out there, who can tell? I once bought a "Template Package" and found out it was pirated from the original creators. They actually said "These templates have been re-sold by a previous customer without the rights to do so, but we have not taken any action because the templates have become so oversold and are now outdated that legal action would be futile".

I will never buy templates from eBay again. Talk about the place where everything has "resell rights" and really doesn't!

There is also a certain limit on designs. Text layouts, picture layouts, css templates, I mean there are only so may variations, so how do you decide what is stolen or copied? Granted, if you copy word for word, but it doesn't really take much variation to make an article different. A few words here and there, etc, etc. Like BlastLTD said, change a few variables like pixel size, and it's not the same. It sucks, but it happens all the time.
