I was hoping to use some user submitted photos from a forum gallery, http://forum.bodybuilding.com/photo/showgallery.php?cat=506, on one page of one of my numerous blogs. I am not quite sure if this is copyright infringement and if it is how do you suggest that I go about getting these images. Do I need to ask permission or are they up for the taking. Its just a publicly open forum gallery...
controlling image copyright infringement in web 2.0 websites is nearly impossible ... I say... hire 2 people or so.. and make them randomly check the images and delete copyrighted images and also post on the forum something saying they will get ban if they upload copyrighted images
Your title says it all. This would be copyright infringement. You must seek permission to use them legally. The problem may be, however, that they are not on the other forum legally either. So, you may have a difficult time tracking down the copyright holder.
Is that your car parked in a public street ? I am sure you wouldn't mind if my friends borrow it for a while then... do ya' ?
What about for a tribute site? Say I want to create either a site or a MySpace page where I pay tribute to a popular sports figure or a whole organization of sports figures... what are the rules for using snagged images for this well intentioned, albeit non-profit venture?
The photographer generally owns the rights to the photos. The sports figure might not care, but it's the photographer that can sue you for a usage fee on their photos. Usually, non-commercial sites (no form of revenue, including adsense, donations, etc) are the last target for copyright infringement - but that doesn't make you immune.
On the internet you can do just about whatever you want, if you get caught though you can be in for big time trouble though.
