Im wanting to create a company name for myself but have no idea were to start. Something like what rich jerk and shoemoney has done. Started off with their own brand company name then built up etc. Any help would be appreciated, thanks Richard also i jus realised i said in the topic title band..i meant brand

bon, I am assuming you are from the United States. If this is the case, I would HIGHLY recommend going to worldwidebrands.com to read their FREE ebooks. They talk about getting legal and it essentially boils down to getting a DBA ($25.00 filing fee here in my state) and then a sales tax id (Required to tax people that you make sales to in your own state) and last but not least a business bank account ($50 - $100 to get one going).
First of all, you wouldn't copyright a brand name, it would be trademarked. You should start (if you're in the US) by visiting www.uspto.gov and searching trademark information. Here are a few things: 1. You don't technically have to register... there's something called a common law trademark that's automatically held by the first person / company using the name in the course of business, or announcing its intended use in business (more complicated than that of course... same names with different industries, same names with different locations, etc.). 2. You'd need to do a pretty thorough search to protect yourself, to make sure no one else is using that name in your type of business in your area (or in a way that would allow them to sell or operate in your area). The free trademark search isn't enough, because of the commonlaw trademarks I mentioned... other things to look at are state records, phone books, etc. 3. As far as filing a name with your state, there are different rules, so check with your state department of revenue or similar agency... in mine, for example, there's a fee to file for DBA (doing business as - operating under something other than your own name), and they also require you to place a certain number of advertisements announcing it in certain kinds of publications. That's on top of the trademark filing if you do that, and the fees for incorporating or other things with the business structure.
So am i and you can still get a trademark just make sure you get most of all the tm's in the main places around the globe as you dont want to have to try and get the trademark off someone else like google tried and failed with gmail for europe hence its called googlemail in europe
