Certainly is against TOS. You are tricking people to click on the ads. It's worth a ban.

    Col :)

Can anyone else confirm this, I don't see it in the tos myself. If this is the case I will pull down the advert and no longer show it.

I think the wording surrounding it might be against the tos, it is good though.

    why don't you email google

I know that its definately the top ad, you can tell when you right click it shows the url. But that is the only way that you can tell. Other than that it just looks like normal content which is very good blending it to your site, but I would imagin it is against Google TOS.

I had an ads skyscraper on the left of my site and then put a similar, but not exactly the same on the right of the page without any "ads by so and so" on it and Google emailed me asking me to either take the ads down from the right or take their ads of the site.

So I took the ads of the right and just put there ads on the right aswell. By the way the ads on the right were links pointing to my other sites.

So because you have an ad up the top that looks exactly the same as all the other things on the page then they will probably say it is against their TOS.

Still best to email them though.

What's amazing to me is that it is consistently showing a GoDaddy ad for me, no matter how many times I refresh.
Is that ad paying well for you, or just pennies?
...because an affiliate banner might do better for you in that space, to be honest.

Nicely done. I'm not sure if it's against the TOS.
From what I hear google has a bad habit of terming accounts when it comes time to pay.

I think it is okay with TOS, but I would edit the text "If you would like to purchase an advertisement banner like this one", excluding "like this one" :)

You don't have to identify it as being an ad by google?

image/text ads of this size don't have "ads by google" on them and some other ad formats as well

about the Ad, i don't see anything wrong with it but prove yourself as a good guy and E-mail google so they decide if it's ok or not and keep the replying e-mail in archive so in case you get into trouble you have a reference ;)
