Enough bad links in ratio to good links, and yes you certainly can be punished for it. It would be close to impossible to have a competitor who had lots of good links already punished, but a new competitor, yes you can.
Well, I am a designer, and I usually have my themes sponsored by great sponsors! some of my hit themes can be found here, here and here. There are many designers who don't do submissions properly! But I'm not one of them. I'm not trying to advertise my service over here, just want to ask you that many people are releasing free wordpress themes, day by day, with almost zero quality. I submit themes on 34 web sites. And send report, after the end of submission! (there may be few links missing, because few sites review the themes before accepting). You can get over thousands of backlinks, from an average design. And I don't think if google is ever going to care for the sponsored links... just my 2cents
see, google will not penalize you just for sponsoring the theme, if google did this than just think about wordpress. as they have already lots of back links by providing blog code for lots of wordpress blog.
They wont penalize you for sponsoring a theme, but the backlinks will count for very little. There is a very real possibility of a penalty if you attempt hidden links within the theme, such as the 1x1 pixel.
Yeah, I do see your point. But, in saying that, I could sponsor 10 templates for a couple of hundred dollars, buy a 1x1 pixel link and take out the two biggest in my niche - Dobbies/Grovelands and Wyevale. Then we'd all be laughin' Especially me I'm not even going to bother. It's more fun when you're just this one guy and you outrank a site which has an entire office headquarters, order processing and dispatch unit - all of significant size - with several people working on their sites 25/7 Heh, it's like Christmas everyday in this world.
If anyone wants to put in the work (spammy directory submissions, creating porno backlinks etc), I'll buy a small website and we can prove once and for all its possible to have a site penalized purely by off-site seo. I'll happily pay for everything needed, but I dont have time to do the actual work.
Won't a new site just get sandboxed instantly if it's only getting spammy backlinks? Could be fun to buy a well established site with good rankings and PR, then try this out, although it'd be more money for the 'lesson learnt' box

Would be good if we could get more guys in on this just to casually get spammy links instead of having to put a lot of focus just into getting bad links. Surely when the sun breaks across the US more guys from across the pond will want to play too!
Actually I think it can be achieved solely with bad directory submissions, social media, and bookmarking. All of which I can do cheaply by using the "services" section. I'm not going to post the url until I've completed the test, then I'll make a thread once I'm done. If anyone wants to spectate as I go along, add me in messenger or yahoo and I'll keep anyone up to date thats interested. Tommorow I'll look for a suitable website.
