hey has anyone had someone put an offer xx over the buy now price after you have used buy now on dp in less then 24hours someone just done this to me and I noticed the seller was online but never contacted me with payment info isn't it a legally binding contract the seller must sell to me first since I used buy now?

I would also like a reccomendation on a good lawyer who deals with this stuff:mad:

a good lawyer will never do that! I will do my LLB from Oxford, I will never look at such cases =p

and about your matter, It is usually like that, buyer has to pay first..He is the actual risk taker so you have to take the risk now :)

    1. Why are you threatening the other buyer? He can do whatever he likes.
    2. If you want to sue somebody you might be able to sue the seller.
    3. No lawyer is going to deal with some petty $150 issue.
    4. Why not relax until you speak to the seller and not threaten people and start threads when there may not even be any issue.

He can not offer a higher price after I have used buy it now in less then 24hours after I already have used buy now so therefore he can not do whatever he likes or make a higher offer as the buy now has already been accepted and seller must sell to me if he had of wrote I'll buy it if the sale doesnt go through I would not have a problem

and who says it would be for the original $150 lol

couldnt care what it cost it's the principle and the seller has been online just hidden I saw when his last activity was but has not emailed me payment details therefore I am pissed off wouldn't you be?

and if you say he can then what's the point of buy it now just to look pretty

I think he owes you the site. However, there is nothing that stops people from making him other offers. I don't know why you keep saying he can't. He can and he did. He has done nothing wrong to you, he has just made a competing offer - it happens all the time in life.

It seems like you are really making a big deal before you even know that the seller is not going to sell you the site. Seems to me that you would find out about that first.

Lastly, regardless of what you think the site is worth your damages are limited, no decent attorney will ever take this case.

    Good luck!
