Forget that ...open an account with hostgator.com and start moving your sites. 1&1 is a piece of shi_t company that should be sued as well for deceitful business practices. You should be able to stop them from hotlinking. I'd also contact limos.com and see if he is stealing thier IP as well and maybe get them to do the lawyer work. You can also register this domain and hopefully pull traffic back... Wish I could help more! You should also be able to IP ban him from your site. Pull his IP range and block the whole range. Im not too tech savvy so somone here may be a bit more into this part.
I would not worry about threatening the host. What you need to do is send them the DMCA remove letter notifying them that one of their clients is infringing upon your copyrights by having copied your site, including copyrighted material, and putting it up on their servers. They will have immunity from suit, but will need to initiate investigations and take down procedures to keep their immunity. If they don't have such a letter and take it down then they could be liable (possibly, maybe) to the other guy for taking down a site without legal justification. I would just send a DMCA letter. In terms of what to do to this guy, are you losing money? He is infringing your trade dress, trade marks and copyrights. You could sue him, but I suspect that is not in the cards, right? In terms of Google, the only thing you are going to be able to do is try and contact them and work it out. I would copy their legal department on the DMCA letter you send and in the copy you send to Google ask them to please add you back. Good luck. -Gene
The guy finally took the website off. Success achieved. But you learn one thing - copyright your stuff. btw: is there a script out there that can hide your source code? Even if it does, is there a way so that no little utility will download your content to somones computer??
yeah you need to report it to the persons hosting company, and send them an email telling them your going to take legal action against them unless they remove the content. I have had to do this 3 times, and on all 3 occasions, the offending content has been removed.
