Someone, it SEEMS, copied my Article Checker online tool. It helps webmasters determine if their content is original (for SEO purposes).

The link above is mine. The purported copy is at hxxp://www.articlechecker.com

What would you do in my position?

Even has a referal system just like my site....

Are you claiming that have full rights to the term "Article Checker"?

Or are you saying they stole a copy of your script that you have exclusive rights for and can prove that it is a stolen copy?

Because your site and the site that you linked are in no way copies of each other. They have some similar characteristics but that is it. You cannot just go around accusing people of copying something when it just is a very smiler service.

sometimes the fast way is to contact the website owner. if he/she doesnt want to cooperate then ask your lawyer.

I have had better results contacting the hosting site to get copied material deleted. This seems to work best if host is located in US or UK.

It helps to get your ducks in a row before contacting anyone. WayBackMachine, whois, etc can be used to show your site was in existance before the copy came into being.

With a script it will be harder to prove I suspect.

I still do not get it. What is it you are claiming he has stolen/copied from your site?

Absolutely nothing because the other site did nothing wrong. Or are you claiming that

    A) they stole your backend code and implemented it on their site?
    B) you have a patent on the concept of using SE's to check for duplicate content?
So you have a patent on referral systems as well? I wouldn't worry about these guys then, I would be busy suing every website on the Internet who is infringing on your patent. Start with Amazon and work your way down.

Seriously now, if they stole this concept from you, then you stole it from copyscape so you better shut your site down right away before they come after you.

d16man, you need to look what this guy is claiming before you give him advice about sending a DMCA letter and getting his ass sued for filing a false claim.

So, what's your point exactly? Someone created a site based on your concept.

Thanks for proving that they didn't copy your website. Just the concept behind it, what patents of yours are they breaking? Feel free to be specific.

And what does your site do that copyscape doesn't? Copyscape was doing this before you did, will you give up your site to them if they come a knocking?

Are you really sure, there wasn't a website with the same concept as yours before your site was launched?

Anyway DMCA is the way to go if you are absolutely sure you are right.

    Your completely off.
Both sites are fine. Infact to tell you a harsh truth.. his looks better developed.
It looks like you both had the same idea if not he took it from you and managed to develop that idea better.

Its backend stuff also. Did he get your code?

Considering he hasnt stolen your script, you dont have the right to do anything.
Its like a website that does file hosting for example saying we were the first file-host, so now all other file hosts must be close.

    Doesnt work like that.

I didn't say it was good or bad...what I offered was that if he needed one(he said he was talking to lawyers), I had copies of them and could offer them....its not my place to decide if his site is legit, I was just offering 2 tools in case he needed them....

I think you should consider to get a lawyer for this matter. Since if there is no prove that they copied from you but just have the same idea with you, it will be useless and costly.
