    If the host hasn't applied to be protected under DMCA then all DMCA takedown order to them is a scare tactic... it's legally meaningless to them.

    Short of being complete idiot's I would review all the literature on the matter and find that "when I'm not protected you can sue me for damages whether I follow the order or not"... course you didn't sue you sent a DMCA order to someone that doesn't need to follow the terms because they have no protection.

    If I was this host and you sent a DMCA order to me... I would say "sue me"... since you can do that already and you haven't - I'm pretty sure you won't.
