Also you could send him a copyright warning, which if not adhered to will be forced to take legal action. Just try to scare said person(s).

Is your content 100% unique? If it is, then contact his host. You might also want to mail Adsense.

This is evidently popular on the web. Often there will be duplicate content of any work. The problem is, you can only sue the Webmaster if they have earned thousands of money to it. It is really a bitter life. But you can always contact Google's Support and they will look on to his Adsense account and would likely get banned. But, your content can never be retrieved as they won't have any jurisdiction on that anyway.

His site comes in search results?

If yes, then you can sue this to report him

    google.com/contact/spamreport.html

There will be a better way, but may be this will also work.

    send him death threats.

    not really.

you could send a polite email though, try to behave like adults instead of getting the teachers involved

Depending on the potential damages (lost rank, lost members, etc) I might consult with an attorney and have a cease and desist fired off with a mention of the $$$ amount you will be filing for damages if they do not comply.

However realize that if it goes to court, copyright law is commonly tried in Federal court. The process of preparing and following through with such a lawsuit can cost upwards of 30k. This is why the content-scrapers do it. They know they can get away with it in most cases since many of us don't have the cash to actually do something about it.

You can also try to find their IP and block it... or re-direct them to a dummy site. Another idea, if they are using a program to copy your content, you can embed little easter eggs of information into the content that only robots see. Things like copyright notices, etc.

I've just had exactly the same thing happen to me. I got the offending site to remove the content in 24 hours. Here's how I did it.

Send a (reasonably) polite email if you can find contact information. If there is none available you can get in touch by querying the Whois database. At worst you will have to go through the hosting company.

In the email copy and paste the following text.

How To Request a Ban from Search Engines - The Digital Millennium
    Copyright Act of 1998

    To take action, Google recommends:

Identify in sufficient detail the copyrighted work that you believe
    has been infringed.
Identify the material that you claim is infringing the copyrighted
work listed in item #1 above.
Provide information reasonably sufficient to permit Google to contact
    you (email address is preferred).
Provide information, if possible, sufficient to permit Google to
notify the owner/administrator of the web page that allegedly contains
infringing material (email address is preferred).
Include the following statement: "I have a good faith belief that use
of the copyrighted materials described above on the allegedly
infringing web pages is not authorized by the copyright owner, its
    agent, or the law."
Include the following statement: "I swear, under penalty of perjury,
that the information in the notification is accurate and that I am the
copyright owner or am authorized to act on behalf of the owner of an
exclusive right that is allegedly infringed."

This is the the law and Google are required to uphold any complaints directed this way. I got the information from a really useful post about when somebody steals your content .

Give the offending site owner 5 days to comply.

Remind the site owner that if they carry on they:

    -risk losing their search rankings
-risk losing their Adsense account (if they are using one)

Do a backlink search for their domain and see if they have any high profile links.
The site that stole my material had numerous links from Wikipedia and I threatened to inform Wikipedia through their complaints procedure.

You can also mention that you will contact any other advertisers and inform them that the site is using illegal copywrited material.

The owner got in touch with me straight away. The perceived threat of losing money seemed to jolt the offender into prompt action.

You have other options including requesting a proper credit and linkback to your site. But I doubt very much if they've stolen the content already they'd be willing to do this.

Be polite at all times and remind the owner of the serious repercussions of their actions.

If after 5 days your content is still being displayed, then go ahead and contact Google, Yahoo, MS, and any advertisers and pull out both barrels. And don't forget to continually remind the site owner of your actions to let them know you're serious.

Hope this helps, let me know how you get on:)

Put a copywrite warning on your site, warn search engines and email that guy warning him he´s copying copywrite material...

    Hi,

I understand that you are in a lot of arrrrrrrrrrrghhhhhh pain, but really... this should go to the legal part of the forum and a lot of people can help you there as that section deals with these issues specifically. :) http://forums.digitalpoint.com/forumdisplay.php?f=44

And you can report it to Blogger directly, since its a blogspot blog I am sure they will ban him if they find the content stolen :)

If your site is already indexed and not his; his site would get penalized for duplicating. So no worries.
