Some jerk stole my whole site, want to see? what should I do?

    Like I said, this dude or chick stole my whole site.

    I own, run, and created http://www.dinosaurfact.net. All content is unique written and the design is one of a kind. Well actually two of a kind because of a following.

    I was checking up on my site and I saw this!!

    http://www.wacky-packages.org/dinosaurs

    What the heck. He took "ALL" of my pages and instead of dinosaurfact.net it's his stupid wacky-packages.org.

    I got his phone number, address, and took screenshots.

    The question is.

    What should I do. The first thing that came to my mind is how can I profit from this, but I just don't want the guy to walk with the site.


    any ideas?

    threaten to sue him.

    tell him you'll contact a hosting provider, etc.

    Honestly, it is a sad part of the Internet. The only thing you can do is threaten him with a lawsuit but unless he lives near by, he knows that it is just a threat. You can contact his host but unless they are one of the big companies, most likely they will do nothing about it. Make sure you have proof that you put up the information first but still may not be enough to do much.

    Did you buy these articles from someone because it looks like one of those MFA packages? If so, he may have bought from the same seller.

    Should be easy to prove if you are Justin Giroux because both sites have that listed as the owner.

    Hand written by myself. Same for the design.

    He doesn't live too close by, so there isn't much I can do about it. I ended up e-mailing go daddy hosting thing but they probably are not going to do anything.

    GoDaddy may do something because they are a big company. Be sure to do it quick before he changes the owner information. It will be hard for him to prove it is his if it has your name on it. Make sure to do a screen shot of his site where it lists the owner just in case he changes it. Besides the host, there is not much you can really do if. :(

    You'll want to hit this from all angles a C&D to the owner, and Takedown notices to host, and all search engines.

    Review Google, Yahoo, and MSN DMCA claim procedures and generate DMCA Complaints ‘takedown orders’ for Google, Yahoo, and MSN.
    Generate a DMCA Complaints ‘takedown order’ for the hosting service provider.

    Reviewing to see if they are on the Online Service Provider Designated Agents list - protected by DCMA Title II
    If not listed (not protected) which means they may or may not comply with take down order. Since Godaddy.com is on the list a takedown order will be acted on immediately... "no questions".

    Proof all DMCA complaints for errors.
    Fax, Register Mail, Courier (and where applicable email) all recipients at the same time.

    Hosting Online Service Provider
    Alleged Infringer
    ...and good to prepare a version for Chilling Effects and your own website and post (exclude all private contact information). This measure aids to curb future infringement. (making a reference with your usual copyright statement will get noticed pretty quickly).

    On receipt of responses, append to original on your website.

    Really sorry to hear that.. what a jerk. I wish I could help you out but I guess contacting the host is the only option you have. I really hope they take him down.

    No need to listen to anything but this. You probably don't need to do all the steps because sending a cease and desist letter immediately will probably be effective. This is a good post on this. I deal with it all the time.

    You are quite obviously in the right about this case, but perhaps brought it on yourself...what's all that bragging about your keyword marketing? Looks like stuff to show SEO clients or for a quick sale.
    Why not just let the ranking speak for themselves? Why do you want so badly that your visitors know they arrived at your site through SE manipulation? You make yourself sound like a blackhat.

    sue him, big time, what a jerk, if you find his address send him a letter saying your going to sue his ass big time and he'll take it down quick im sure.

    the sad thing is... google's going to think its all dup content and stuff

    how did he get your code may be he is on the same shared host on which you are . if not then see may be there is a loop hole in your server from where he entered your host ... and got the source.

    That's a disgrace. Ripping someone else's site is taboo. Obviously he liked your site enough to sleuce it. You could write to the hosting company as they may have a strict policy about site content and if there's any doubt they may ask the owner to rebuild it or they may suspend the account. Do that dude!

    Sad thing is... you're pretty dumb if you think that means anything.

    You could make something (a website) and I could steal it, you could find it, and threaten... and when I say "go for it"... you will soon find out that it isn't that easy to "just sue".

    If you don't have registered marks or register copyright -- you're up shit creek and can't do a damn thing.

    I'd be interested to hear how GoDaddy reacts to this. I had a very unsatisfactory interaction with them over a site that was absolutely laced with spyware and keyloggers that they were hosting. They're still hosting it.
