Some guy uploaded a movie trailer of myn is this allowed?

    Well i downloaded a movie trailer from apple, about batman the new movie.

    Than i uploaded it to youtube. I haven't modified it at all.

    Yet another user has obviously downloaded myn and uploaded it as his own. Is this allowed?

    I mean since its a trailer?

    Or do i have right to ask him to remove it?

    Neither one is allowed. Both belong to apple.com since you downloaded it from there.

    But its not just an apple trailer. Its the official trailer of the movie. Used by everyone. Apple, john smith, tyler crow, bla bla, everyone.

    Someone has copied one of my youtube video movie trailers and uploaded it as there own. Sure its only a movie trailer though.

    But are they allowed to do this?

    It is an original movie trailer

    (Had to make another thread as i got no answer and was informed it was posted in the wrong section. Cheers)

    If it's original and you're the creator then yes you can ask them to remove it etc. But you need proof that it is your own. If it was a movie created by someone else then you would also be in the wrong.

    oh I see the video in question is the batman movie trailor, lol, well it's not yours anyway .... so you are actually in the wrong.

    Yeh well its not that video. Im just using it as an example.

    But it is like an original movie trailer, available to everyone. So like i presumed at the start hes in the right to upload it as his own!?

    No matter what video/material you refer to, unless you/anyone owns the copyrights on that particular material they do not have the RIGHT to argue or claim for the rights on such materials.

    Coming to other point, well if the other person uploads the video it doesnt mean that he has created it or owns the copyright for that material. More over its an added advantage to the movie creators as they get extra push and popularity for their movies.

    As you said u gave an example, if you concern such things then both of you dont own the copyright for that material so where is the point of questioning each other for the rights?

    Yeah I am lost with this one, it's ok for you to download the trailor from apple - not modify it ? and then upload it, but because you have done this - nobody else is allowed to ? I don't understand why you are allowed, but the other guy's not allowed to ?

    lol More like no one is allowed. If the copyright notice on the original video / or TOS on the original site doesn't say you can download it and use it as you please, you had no right to upload it to YouTube to begin with.

    Actually, you can video stream from Apple but you are not allowed to claim that they are your own or share it online. Apple would have explicit permission or arrangement with the copyright owners of the shows (the studios) and thus you see the trailers on their website.

    If you did not have the same arrangement with the copyright owners, you cannot use them on your site in any way or form, this would include putting them up at youtube with or without modifying it.

    What you think does not change what is the law.

    Of course with youtube, if you made the videos then upload it then you are entitled to add a logo or something because you are the copyright owner of your video.

    Well youtube has hundreds of original movie trailers. Often duplicate used by other members.

    If its not allowed than why have they allowed it to continue over the years?

    Like I said earlier, Youtube had agreements with the copyright owners to host those trailers and contents.

    If you did not know about that, please read the following examples of agreements :-

    If the video is made by you, you're the author of the video, you can contact the uploader and try to get him to remove the video, because what he's doing is copyright infrigement.
    But since this is a trailer which is not yours i.e it doesn't belong to neither you nor the other uploader, anyone can upload the video.
    I've been ripped off(if you can call it that), and users have uploaded my videos.

    So now.. everytime I'm about to upload a video, I put a link to my site or a watermark on it, so even if they rip me off, at least they'll be advertising my site :p

    Well what a joke to read right from the first post, of course you can't steal videos from apple then warn other people not use that video.

    Have you got any common sense at all? why would you need to ask that question?

    Your misunderstanding the question here. That was an example.

    Not apple not anyone.

    It is "original movie trailer". The movie companies won't care its more publicity. Across youtube people are uploading other peoples trailers which have not been personall edited. !
