Social Media Legal Advice

    Hi all,

    (Firstly, please forgive me if I have posted this thread in the wrong section.)

    I am located in Melbourne, Australia and currently in the process of building a new social media app for iOS. Without going into detail, all content is user generated with the ability to interact publicly or privately.

    As a result, like all social media platforms, we need a Privacy Police and Terms of Service. With social media playing such a major part in lives these days, I need to ensure we cover all bases.

    Are there any online-lawyers (or local, for those in Australia) that can help draw these up in partnership to ensure as the app owners we are protected, as well as all users within the app? What type of lawyer should we be seeking advice from?

    "in partnership" means for a % of the company in lieu of regular fees?
    I don't know about Aussie, but Kiwi lawyers tend to shy away from those kinds of arrangements.

    Sorry, probably a bad choice of words. By partnership I mean we create the Terms and Conditions as a team together, so they personalise the conditions to suit our app, rather than a broad 'typical' set of Ts & Cs that have just been copy and pasted.

    You can't beat sitting down face to face with your lawyers to thrash things out. Do it over the phone or skype and you can miss subtle cues about things that may need additional care. Talk to your regular lawyer about who they recommend for a job like this. Our lawyer thinks of himself as a legal "GP" - can handle the easy stuff but will refer to a specialist for the tricky things.

    Lawyers won't really go for this kind of arrangements. I would say, you better consult a practicing attorney and shell out that initial investment. If you are really making something worthwhile, it is very important to patent that "thing". First things first, you have to produce a MVP and get a patent filed. Shouldn't take you more a few dollars (two digits, of course).
