Hi Guys, first time poster here but feel i need to heed some advice... Went in to a car company (peoples, who sell fords & mazda) ...wanted to buy a car off them as my own ford was 4 years old and felt it was time to upgrade. this is what happened and id love to know if anyone can help me by telling me "legally" where i stand...... Sat at the desk with the sales person, told them what car i wanted and was quote a price of 9,800. I said that i didnt know if i could stretch to this and so would come back later on to after discussing with parents.... came home, discussed and realised it was too much and said i could afford no more than 9000 they said the lowest they could go was 9,400 and no lower , so i though yeah ok ill go for this as i do want my new car for september and its not that expensive really....... we agreed, shook hands and was told to come back for car on september 1st when it would be in....... by agreeing to the price they offered it to me they presented me with a contract to which i filled out all my details and they filled out the price of the car and the specifics - model, colour etc..... i signed it.... but they did not.....appently any deal by a car salesperson needs to be signed off by a manager -and i was unaware of this and as far as i was concerned it was deal done.... they offered a price to me in writing and i signed it not knowing anything more than this and returned home expecting to pick the car up in 3weeks time.... then disaster struck.......2days later i recieved a call saying unfortunately the car had been priced up wrong and they want another £2000 for the car otherwise i cant have it....... i said that this is completely unacceptable as we had a deal on the price i was getting the car for........... they said as a gesture of "goodwill" they would just be asking for £1500 instead of 2000 but to me this is breaking the law............. the minute i was offered the car by people in writing and i signed, to me , and by the law as far as im concerned this is a binding contract.......... ive since threatened to take them to court and they seem willing to go, but can anyone actaully tell me where i would stand in court or legally do I or they have a leg to stand on. Im sure im right that by accepting something offered to me it is binding.... any information ,thoughts or experiences would be greatly appreciated, thanks so much. Simon
Simon, You can't prove that they agreed to the price you say they did. While I agree that they should honor their promise, since they did not put it in writing and sign it, you can't prove it... ~Adam
Hey, Unless you have a copy of that contract, it's a no go. They won't forfeit that evidence for your case. Hunter
