    I guess you all know smileys like this: http://www.mysmiley.net/
    You see those everywhere around the internet.

    My question: who created them and who has the rights on them?

    May I also put those on my homepage without asking anybody?

    The smileys on that site are free to use. Smileys you find made by other people may not be. You need to check for each image you want to use.

    Okay, well that's clear of course.
    What I'm talking about: what happens if I have my own smiley website and provide them there? could I get trouble? or is this some kind of really-free license?
    I'm wondering because I see those smileys on the whole internet, and there are also various smiley sites which provide the same smileys.

    I think they are repeated all over the web so much that no one knows who they belong to.
    I'd suggest using them but providing a means for a copyright holder to contact you, if they wish, to request removal.
