Slogan trademark

    Hi

    I have used the slogan: "the place to play" but i have just found out that someone else has a trademark called "places to play".

    Will i have to change my slogan or am i OK?

    IANAL, but I'm pretty sure the answer is "it depends". The test of trademark infringement is whether it's a the same or similar mark applied the same or similar goods or services, and whether there is a "likelihood of confusion" with the original trademark holder when people see your use of a similar slogan.

    Trademarks are specific to the type of business, so it depends if the trade and/or services you are offering are the same as the trademark holder or not. If you are in the same business - e.g. travel services - you are more likely to run into a problem than if you are in different types of business.
