Hey guys I just wanted to ask your opinions on this, is slander against the law? What should I do if someone keeps making websites about with that arn't correct information and are giving out my personal info, and bad mouthing me. I do not know who it is but I keep contacting the hosting site that he uses and they delete it, and then he puts it right back up. And I am kinda tired of it lol Thanks Bryan
I don't know about the slander part but definitely if he is posting your personal information, that would not be legal without your permission. What is the gist of his comments? For instance, is it a competitor trying to shut your down? Look in the whois and see if you can find out who it is and send him an official cease and desist. It does not have to come from a lawyer's office but make sure your writing is professional enough that he takes it seriously. Also, at the bottom of the letter, if he is in the same state as you write cc - Better Business Bureau cc - Attorney General (guy's real name) cc - your lawyer;s name anywhere to scare the guy off
Oh alrighty thanks! No he isnt trying to shut me down or anything, he is just some teenager that got my information somehow trying to get me mad or tick me off. its really childish if you ask me but i just needed to know some ways to get it stopped.
In most areas, slander is against the law. Make sure you take screenshots of everythign and save them, in case you need them for future legal action and he takes them down.
It appears that you are a victim of libel. The laws can vary drastically depending on where you live and where the accused is based. In the United States, libel is much harder to prove as we have 1st Amendment rights to free speech that extend further than most other countries' free speech laws. In the U.S., libel is usually a civil offense, although in some states it can still be considered a criminal offense. Your best course of action, if this is really bothering you, is to contact a lawyer.
I add it sounds like online harasment too if it has caused you "substantial emotional distress". Online harassment can be a crime but laws vary from state to state.
