I was wondering if someone could help me out with a domain problem. I own a www.[domain name].ca which i clearly state on my website is not affiliated with [domain name]-c.com or [domain name]-ccanada.com in any way and offer a link to them...but my website is alos redirected to my other e-commerce site which sells the products made by this company... they are telling me that I need to take it down to avoid confusion. Is it legal for me to keep my site up if i have this disclaimer in BOLD saying that I am not affiliated with the offical website?
I do think they have a point - I mean you say you have no relation to the company, but in fact you sell their products. I think you should just offer your URL to the company whose products you sell > sounds like you have a better domain name then they do. I'm no lawyer, but this seems like a pretty clearcut case. Make some money off the domain name and get out.
If you have any agreements with the company in question, you'd better check them out. And no, a disclaimer isn't a 100% shield if you're still found to infringe a party's trademark rights, which your site is currently doing.
