Should I sue Google?

    They clearly have information which has resulted in the conclusion of invalid clicks, e.g multiple from same IP. unless you have data to counteract this consider your money and account gone.
    No offence, but it's good that Adsense keep such close track and ban so many offenders, because otherwise ppc would be ridicously low and there would be no point in using adsense.

    If you really think you're right in every respect, go fight for them until the end. Maybe your voice may be heard by Google officers and a lot of people be informed.

    The TOS is a contract every one has to sign and you didnt have any say in any of the terms which would mean the court would give you the advantage i would try and sue them.

    Well.... can you afford an attorney?

    I mean this is a Federal Case and federal attorneys start at $50,000 and you know google will have a wall of attorneys in the court room fighting your one
    maybe two lawyers (unless your martha stewert and her 100+ lawyers) so you have to ask yourself is this worth the aggravation/money if i lose?

    Ultimately the choice is yours but you had best have a good case and make the judge realize that google is monopolizing the web and/or are harming others with there actions and be able to prove it. (unlike the last guy whom fought them for dropping his PR and lost due to "our engine and we can do what we want excuse") That may be different now if you can make the judge understand that google controls 80% of the web compared to when that guy tried suing them.

    Do i feel googles negative actions deserve a day in court? Maybe...

    They destroy peoples sites and livelihoods so that their empire can flourish while the common webmaster is made to jump threw hoops and gets nothing in return but hardships & penalties and poor pay. The web isnt owned by them but you have to wonder sometimes if they dont think they do own it.

    Now you have to remember that TOS you signed is there loophole and salvation so...

    Anyway... i wish you success if you do decide to fight if not just get another advertiser and take your loses with a grain of salt.

    Although I am one of the banned person who share the same fate as you, I do believe that it will not do any good to sue them. Why? Because the moment you sign up with them, you agree to their TOS and they pretty much said invalid clicks/activity will certainly banned and they haven't said anything like they will explain about that. So, usually people make inquiry before signing up like "so google, if invalid activity detected on my account, would I be banned? and will you give a reason?".

    By that, even if you sue them, they would/will win.

    I think they have clearly stated that they have the privileged right to cease any adsense account for any reason. I'm afraid you can't sue them on this.

    I think you are fighting a battle you can't win. Better to go have somebody you know sign up for an account? You wife? Friend? etc.? If you need this income.

    If you feel cheated, because you didn't do any invalid clicking, write a polite letter/email to the adsense team asking them to look at your websites again.

    well when you signed up for adsense you agreed to their TOS and clearly states that they reserve the right to cancel any account without payment for practically any reason of course they're going to say invalid clicks and what not, unfortunately my guess is that someone sabotaged you by clicking your ads because if you think about it how many clicks does DP get? a lot I assume and did sean ever get banned? no he didn't so it can't be because of that.

    The best thing you can do is get a professional writer in law to write a letter to the adsense team regarding your account and get it notarized in which case they will respond faster and should give you more detail however, you will not win in a legal battle.

    I am afraid that there is nothing one can do against Google once they decide to ban you, as the terms are stated in their TOS.

    Lets play the game with their ToS in account itself.

    Stop worrying about Adsense and assume the money you have earned thru adsense had been lost because of a pickpocket. And forget about it.

    Presume that this is the right time to look into other ad servers and try to learn their rules of the game too. After 3 months, send out a mail to google asking them to review your account one more time and if all goes well, they will surely give back your account.
