It is legal as far as it goes. However, it does not address dozens of items anyone should incorporate in a good TOS.
What are you trying to accomplish here? You have to be specific and we can help you from there, because even if you put that and your trying to protect yourself from getting sued it won't happen, it doesn't matter if they agree to this, sign a contract, if there state law/country law oversees what your TOS/AUP/LEGAL will ever do. Give us more info and I'll see if we can protect you in a better way then what your currently trying to do.
