Thinking about this more, they are likely to drop the case if there is a chance of any case law being produced that would hurt them. Although there are a plethora of judges who are plainly uninformed regarding modern technology. I would hope that wouldn't be the case in southern CA, but if my traffic case is any indication, you are going to have to educate every judge at every level about the facts and the history the MPAA's attorneys have of "accidentally misrepresenting" reality.

I would fully expect them to drag this on, hoping the publicity will subside, and then drop the case all together. What they won't get is that the longer they hold out, the more the media attention will grow. Big score for getting a plug in a major magazine this early on in the case, but I would venture to say that the tech crowd is already well aware of what is happening and so the damage to the MPAA is nominal at the moment. When a publication like Newsweek, Time, or something like that takes notice it will be exponentially more damaging.

It would be nice if protections from mass corporate lawsuits became an election issue rather than the other way around. DirecTV and the MPAA were directly responsible for clogging the dockets all accross the country the last two years and they've been getting away with 1/10th to 1/20th the legal fees that most people would be facing trying to sue that many people at once by joining defendants who don't have any relationship whatsoever in single claims.

Their bigger problem really has nothing to do with my individual case. What they are going to find out is that I personally don't care about the outcome of my case. I don't really see any good outcome for them in the long run unless they have me killed (this is not a suggestion for the MPAA dudes that I'm sure are going to read this at some point.. heh). If they drop the case (or if the legal system lost it's mind and I lost), then I could just find other people they are doing the same thing to and just fund their cases.

If I were them, *that's* what would worry me. Some guy that has the resources and needs a new "project" to keep him busy.

As a matter of fact I do, but rather than go public with it you can get him via his contact page ;)

And all DP members will get a good discount with all profits going to the "Free Shawn Hogan" fund, right? ;)

Time to bring out DP Crack Escape Squad again. I knew there would be another use for that picture.

Good for you, Shawn. Both for the article (shame about the serial killer look you had going on that day) and the stance you're taking.

Just a thought but couldn't you sue the people trying to sue you for involving you in a frivolous lawsuit to prevent them from getting off the hook?

If you do go to court and they lose. You can sue them for your legal expenses plus other stuff, right? They brought the case.
