    It is amazing to me how many people here support illegal activities just because it was the founder of the site involved. I don't know if he did it or not, but to be supportive of criminal activities just because it earns you some money is a sad testament to the juvenile mindset that this forum seems to bring out.

    Justica has updated with another document stating their case. It looks like they've added Racketeering to the charges they are trying to lay against them (or was that present earlier? I don't recall reading that section before).

    The other change I noticed when reading it is they've established the trial will happen in 'Northern California', and it looks specifically to be San Jose.

    There is a First Amended Complaint filed on October 7, 2008. It look virtually the same, all the same allegations and requesting all the same relief. It is probably some small change in one of the allegations. This complaint is filed in United States District Court - Northern District of California - San Jose Division just like the original complaint.

    The practical effect is that the clock starts over on when the defendants must respond. Looks like they have at least another 30 days or so.

    *sigh* It's not illegal. It's a violation if just about every Affiliate Program TOS though, and that's why his nuts are in a vice right now.

    Shawn and 2 other people are being sued by eBay for violation of their Affiliate Program TOS, and a big part of the case is that eBay lost a large sum of revenue because of it. Since Shawn and his buddies are big fish, ebay is suing them for what will probably be in the $1-3 million range (though the court documents all say "For an amount presented by evidence at trial"...so who knows exactly how much they are going after).

    Cookie stuffing by itself isn't illegal (though it should be). But eBay is suing them for violating their policies for the past 4 years, and claiming they made a lot of money that wasn't theirs to start with.

    2 Statements:
    1) Cookie Stuffing is LEGAL
    2) Shawn and the other 2 people violated the Affiliate TOS and eBay suffered, that's ILLEGAL. They used Cookie Stuffing to do it though.

    You are totally wrong again. Read the case, and focus on the causes of action. They are not being sued for solely for breach of contract - which is what a TOS violation would be.

    Actually lots of the charge are very much against the law.

    I'm pulling this quote from my 1st blog right after charges were filed.

    "There were 6 charges filed including mail fraud, wire fraud, racketeering and violation of the Computer Fraud and Abuse Act."

    I read the new justica doc a few days ago, but don't remember point by point if all the charges are the same or if any were added.

    I think to boil it down in simple terms you could say that what ebay alleges is that those guys STOLE commissions from them they didn't deserve. They did it via cookie stuffing and there were also elements of mail fraud, wire fraud, racketeering and violation of the Computer Fraud and Abuse Act.

    I think precisely because cookie stuffing is not illegal.

    Also cookie stuffing is highly misunderstood. If a bunch of Internet marketers and web masters on this forum don't "get it" I'm sure eBay knows they will have a hard time educating average Joe juror and the Judge.

    So additionally all those charges are ones people have heard of and understand to some degree and all were used to commit the crime. (allegedly according to the docs). They are common charges to be brought in finanicial and fraud type cases.
