Shawn Hogan (Owner of DP) Is Getting Sued For Cooking Stuffing

    Lets be real here. Ebay would never sue the wrong guy by mistake. Can you imagine the bad press from from that? Not to mention the countless counter-action Shawn would take for stress, false claims, slander etc.

    Wrong again. Ebay PAY affiliates $25 per signup. The user does not pay the affiliate, it comes from ebay. They then pay a % of the auction revenue to affiliates too. Thats money they'd be keeping themselves had no affiliate referred that auctions owner.

    Ok, lets get real! last time the MPAA or whatever made a claim and then this is what happened!!

    humm...... lets see...... suppose you are ebay and am the visitor, i sign up using an affiliate link and then you pay $25 to that guy from his affiliate link i came, or instead i simply go in and sign up without clicking any link! This is my choice right, i prefer to go from an affiliate link, i feel more secure doing that :)

    Seen as Shawn wrote a couple of years ago on Shoemoney's blog that he did cookie stuffing, I really doubt its a mistake. If you read the court document properly you'll also notice that they have been investigating this for a while, right back to when ebay was run through CJ, not EPN.

    I think you are missing the point. Ebay pay $25 to affiliates because it was the affiliate that referred them to ebay. The affiliate did the hard work in advertising ebay on their behalf.

    Ebay is suing because affiliates didn't take the correct action, they cookie stuffed and made money because the average web-user that knows nothing about affiliate links later stubmled upon ebay and took the action that was then paid out to the affiliates.

    Therefore putting ebay at a loss....

    Yep after going through that blog coment of shawn, it looks like he did that, unless it was someone else commenting with a name of "Shawn"

    Yes i can understand that point, but still it dosenot looks that bad to me. I as an average web-user IF feels secure to use that affiliate link of yours, or your COOKIE to visit ebay for purchase....... anyways!

    You are not an average web user though. You are a webmaster that knows about affiliates, EPN etc.

    Anyway, as a webmaster you still probably wouldn't know if you'd been cookie stuffed or not...

    I think you don't understand how the system works, it takes money from other affiliates also.

    If your an Ebay affiliate, i click through your link then bookmark an auction then come back on the day it ends and i bid and win you get the commission right.

    In the case of a cookies stuffer, i click your link then bookmark it if i encounter a page cooking stuffing in between clicking your link and returning to win the auction your cookie gets overwritten and the cookie stuffer gets the commission and not you.

    yeah true it is.... am sure he made alot already.. so he wont afraid to share either 10% of his income to his lawyer, so he can make out escape from there...

    Guys, lets learn cookie stuff and do with affliates ( its short way to earn money ) :D :D

    It is true that he was sued - that was obvious from the complaint.

    Whether or not he did anything that will be considered wrong by the courts or a jury has yet to be determined. Let's just hope he has a jury a hell of a lot smarter than the people on this thread.

    Yup you are right...i myself got upto 10 ACRU's in a day through cookie stuffing :D....Ofcourse i got banned the next month..but recv payment for that month :p

    And yeah , i didnt stuff on DP..:)

    Frankly anyone can sue or be sued, that really does not say anything. It is the verdict that counts, most of the time. But frankly whether you win or not in a civil suit also depends on how deep is your pocket.
