I suspect its all sub-judice (do you have that term in the USA) where you can't talk about a case that is before the courts until it is all done and dusted. Makes it hard for the defendant to look credible because they can't say a thing. That leaves us with the people who know nothing to talk - so you can pretty much assume that anyone posting in this thread has no real information (and yes, that does include me).

    1. Unless the court orders the parties not to talk, they are free to discuss the case.

    2. Only a fool would discuss their personal case online. There are two good reasons. One, there is nothing to gain. Two, anything said by the parties to a case can be used as evidence. Only a fool would come onto a forum and try to explain to a bunch of morons the legal complexities of their case. It is really pretty amusing to me when I see people talking about their case in the legal section of the forum.

There is nothing on the record but an allegation by one side. The US legal system is an adversary system. Each side is not presenting a neutral truth, but rather advocating only the position of their client. Basing a conclusion on a complaint alone is nonsense. In due time the other side will explain their positions. Only then would someone even begin to be able to try and assess the merits of the case and the defenses.

Wrong. eBay is not a gold-digger suing a big name for undeserved money, instead, it is The big name suing a small one who was allegedly doing not only imoral things but illegal, too. So, Not assuming so is that is absurd.

I don't have my adsense at DP. And I leave when I want to, not when a bully says so.

    Exactly.

Damn, no wonder topics get closed everytime someone says there should be DP Cops running around busting people for doing scams.

    Just joking.

In a more realistic statement, this is shouldn't be shocking if its true because like 95% people are not honest, but it is to me still.

    1. You are judging the merits of ebay's case, without a clue what the defense is or maybe. Anyone who judges a case based on the complaint alone is just foolish. Who said anything about ebay being a gold-digger? They may very well think they have a case - that has nothing to do with whether they actually do or not.

You sound like one of those people who think just because someone is being prosecuted for a crime there must be some basis. You seem to ignore the whole point of the trial.

    2. I certainly was not telling you to leave. I don't care one way or the other. I don't put my adsense on the forum either. So then what the hell was the point of your baseless accusation/question about cheating people out of their adsense share? Just thought it would be fun? Nice to see you make baseless allegations. You, without even realizing, have proved the point that anyone can allege anything, even if it has no merit and zero factual basis. Nice job.

Just because someone files a lawsuit does not mean it's true.

However it appears Ebay has succeeded in having people like ourselves discuss this, and try and deter people in the future from participating in activities that may be construed as fraudulent.

Weather it's true or not, That's not your money so Shawn didn't steal it from you. Ebay is the one who stole it.

It's so easy to get away with it if he wanted to, by spreading that cookie stuffing to the public.

Maybe not, but people don't typically sue random people off of the street. Even if Shawn isn't guilty I find it stupid that such a rich dude can be connected with such a scam.

    Yes that's right...

This is only a lawsuit and we should not jump to conclusions without having any evidence...

We should wait for the court's judgement...

Of course it is not random, and yes, many times people sue based on their belief and the facts do not back them up. That is the point. Someone has merely alleged something, they have not proven it. Yet you already take the position that there was a scam? What do you base that on, other than a mere allegation?

I don't know Shawn and frankly, I am sure he does not care what you all think of him, and I certainly don't. I was just trying to help people who may not understand the adversary nature of US civil proceedings. You are certainly free to have any opinion you want.

Yes, that's what makes him a horrible admin. No offence, but that's the honest truth.

Not really. I believe they can say ANYTHING, however MOST people in a lawsuit don't say anything at all. Do I expect Shawn to comment.. not really, because I know he won't.

I'm not to worried, because sooner or later the case will be closed and we'll see what happens.

It must be a bug in vbulletin or some scripts , **** ebay , worst company you will ever want to do business with
ebay should fix the bug in their cookie logic and should not go about suing people.

You can not get sued for a software bugs like this.

eBay are the biggest crooks ever, I guess they are just trying to re-coup part of the $63 million dollars they were ordered to pay Louis Vuitton for continually allowing fake copies of there goods to be sold, not to mention the other millions of fakes/copies sold each month on there site. They just don’t care.

It is a law suit, of which we do not know much except what was reported. Too early to say anything at all and whatever had been said so far is too presumptuous, I would say just let the law runs its course.

This is a very good point - if - big IF - anyone has in anyway got money from ebay in an underhand way that is, of course, a bad thing. BUT ebay are hardly whiter than white

Nobody said they used a forum, let alone DP. Blaming vbulletin is pretty daft tbh.

Anything said at this point of time are all speculations at most and it is amazing to see the number of out of the world speculations with regards to this case. Wonder how would Vbulletin owners react when they see such threads.....
