    I thought sex was a trademark name. See below.

    Houston based Marcus Schatte who has registered trademarks incorporating the word ‘sex’ for several products that he has developed, argued that he should have the sex.biz Internet address too – on November 4the arbitrator Irving Perlus agreed by awarding him the name.
    “Although the mark ‘sex’ may be generic, the complainant demonstrated to the United States Patent and Trademark Office that there is a distinctive, unique or secondary meaning to the mark and was granted full registration. He issued the decision through the so called Start-up Trademark Opposition Policy, which handles disputes relating to new top level domains, such as ‘.biz’.
    Perluss concluded that the original owner of ‘sex.biz’, Osan-si Kyounggi-do, resident in Korea, did not have a legitimate claim to the domain name. He highlighted that the owner had no product or service with a name linked to the domain name and the lack of evidence that the owner intended to use the name to offer goods or services.
    Other legal experts were surprised, however. “The problem is, the panel said that if you have a trademark, you must have the right to preclude any use of the domain name”, said Professor Mark Lemley of the University of California, Berkeley. This is not the first occasion on which ‘sex’ has been at the centre of a domain name dispute. A legal battle was settled last year over the rights to the ‘sex.com’ domain name. That case however involved the theft of the domain name, while the current case touches on the rights a trademark confers.

    Hectic for a .info domain. Maybe the .info extension is coming of age. The publicity from this will trigger interest in the extension, I'm sure. Maybe we are looking at a huge .info grab.
