Setting up a Refer a Friend Progam (legal standpoint)

    I want to be covered legally when I set up my refer a friend program for my site. I will payout using paypal. I see big companies like ING, car dealers, poker sites, etc do this all the time but they don't seem to have a specific TOS or anything to sign when you refer your friends to them. They just put cash in your account or give you gift cards.

    Would I need to have a detailed TOS for participants in my program to agree too so I'm covered legally? Or could I just do it like the above mentioned companies and say refer your friends for cash and not have them agree to any terms?

    Anyone have experience setting up a refer a friend progam for a site?
