    I rent a dedicated server at server4you.net.
Today this email came , see quote.

What did a technician do at my server without permission?
Shouldnt he prove he didnt format because a competitor bought him to do so?

Destroying 1 year of work and 2000 customers...

Can you recommend a good lawyer neat St Louis?
A good lawyer somewhere in USA is ok....

They just must pay for a fatal mistake, and doing that without permission from me (accessing the server).

It is hard to tell from that email what exactly was going on. However, they were probably not doing anything with your site specifically, rather the server itself. It is common for hosts to regularly do security updates to their servers without permission from those using the server. They wouldn't be a good host if they did not do regular maintenance.

That being said, I can't think of an update that would format the drive. My guess would be that either the wrong command was run or they were working on the wrong server (thinking yours was one scheduled for a rebuild).

They do explicitly state that you are responsible for back ups and that they are not responsible for data loss. Generally, that would be enough to shield them. However, since this was directly the product of their negligence/incompetence, it may be possible that the circumstances in this case would override any such clause in the user agreement.

I don't know of any lawyers in that area of the country. Sorry. Another user often suggests http://www.internetlitigators.com/
