Yes you need to take action and get him out of there! You should have copyright merely by creating your site. Technically you don't even need to register for it, but it makes things easier if you do.

arghhh I just noticed this thread was back up again! I thought I was done with him. I'm thinking of another solution because if I close him down through his Host again... he'll simply reopen it somewhere else. I need to teach this guy a lesson!

I contacted my Host earlier last week and asked them to send me a full log of IP's that accessed my server. The only IP address was mine. They said that I was the only user accessing my website's cpanel.

I also spoke to Erik and he said its impossible he copied my files. Our guesses are that he used a webcrawler to duplicate my website .. or simply copy pasted my website's source and went from there.

Not today, but I spoke to Erik last week about this and he said he most probably copied my site page by page ... not by database

wow very interesting, he just copied each page, can be done but requires patience which he obviously has.

Good luck with this. Hope you get him shut down and get some money out of this, after all, time has been wasted, right?

I`m trying everything I could to get him shut down. Still waiting for a respons from his host.

I do not know what the laws between Canada and U.S are over copyright infringement.. I`ll have to take a deeper look into it!

Steps to be taken to against Plagiarism

    1, 2, 3. You have already done.

    4. Send a formal 'Cease and Desist' letter notifying the offending party that they must remove the stolen content from their site. Some sample letters are available on the web.

    5. File a notice of Digital Millenium Copyright Act (DMCA) infringement with search engines such as Google and others to have the offending site removed from their search results.

    6. If you need proof of infringement, you can use the Internet Archive to show that the content appeared on your site at an earlier date than it appeared on the offending site.

7 . Should you supply a DMCA notification for content, his host can request that duplicate content be removed from any other domains on his account. Otherwise the host will not do anything.

I have the similar problem and fighting for the same.

okay first he did not replicate your site, he's using a proxy like system. try banning his domain, you can do this with modrewrite.

If you hired someone to design your site maybe they resold your design.

If he lives far from you, it will be hard to sue him.

I would contact his host and tell them to take his site down and suspend his account for breaking there terms and conditions.

Sorry to hear about your problem and good luck.

    Regards
    Aguila

Wow how low do people go these days, seriously originality is like a distant past these days. Everyone just copies each other, Its just not the way forward.

You can WHOIS the person find out where they live, visit them. Chop off the legs of him/her and family and set the house on fire and watch as they drag themselves out of the flames all stumped and bloody and in flames. I hate when people steal my content!

I belive what has happened is he is simply re-routing all your site content through his and replacing the ads, Like a proxy script i've seen before

Is there any way that I can block his domain from accessing my content?
