I don't know how even a human can say a site is being penalized by simply having a URL. You have to know the history of that URL - where it used to rank and for which keywords, where it currently ranks for those same keywords, whether it used to have a visible PR in the toolbar but does not currently, etc. - before you can even begin the research process required to determine if it even "appears" to be under penalty.

Another thing is that typically "sites" do not get hit with penalties... the offending URL does. Sometimes in severe cases the entire site may be penalized. But typically if you have one page on your site that is doing something bad, Google will bury that one page in the SERPs. Other pages will continue to rank as they had in the past, but nothing you do (short of fixing the violation and submitting a request for reconsideration) will make the one penalized URL rank.

I would have to say, no. This site is a hoax. It's probably just link bait to get desperate people to link to their site. Although that doesn't appear to be working either. Looking at them in Yahoo! Site Explorer they appear to have a single external backlink.

There are so many types of penalties and it will be rather difficult to say a URL has been penalized unless you know history of website's rank, PR etc.

i know i previously said i cant see where it would get data from,

but i ran a few sites threw it, 2 of which i knew had been penalized in someway by google. It flagged these two, one as penalised one as banned.

I fully expected this too! Who ever developed it, can we see your php script to see what data you collate?
