First off, ICANN doesn't make trademark law. Using youtube in a domain name when the content relates to the same usage is trademark infringement and the owner can be sued. BTW, the name alone is enough to cause confusion in the marketplace and a disclaimer doesn't afford protection against infringement. A visitor has to visit the site to see the disclaimer, and by that time, the "damage or theft" has been done.

You are also sadly mistaken if you think because someone else on the net has done something, it must mean it is ok.

If you are so sure there won't be any problems, why don't you send an email to youtube and ask them if it is ok do use the domain name and offer the service? lol.
