Imagine i have a blog or any other site that has warez content in it.But all warez file are uploaded in external site which is offshore and links are provided in my blog.And in the TOS of my site,all this will be mentioned and members will have to use everything at their risk(including legal issues) Is it legal for me,if my blog is hosted in onshore host
I think it's illegal either way you look at it. You would be supplying links to illegal content. Thats why most hosts don't allow wares or links on their server. I would not take the risk. And also, most wares contain viruses/trojans/worms, etc. No matter if you put a disclaimer some users are going feel compelled to click the link, even if they just want to have a look. Would you want your site visitors to have their computer infected from a link you supplied?
Giving out warez is still illegal. Look at Napster. They didn't host the files themself. The users hosted the files and used the service to find out where the warez was. Theys still got sued for it. Even if it is uploaded to a country with lax or no copyright standards. You can still be hauled to court for it. And the term off-shore doesn't really mean much, because Europe/Asia has copyright laws that you have to follow. Just don't get into the warez market.
then i don't want to have warez at my site But what will happen if someone was caught for warez.Laws of every country will be still different.According to which law will the webmaster be punished.Will the host get any problem.Or they just ban the site leaving the webmaster Look at this site : www.sharestation.com they have warez links that are posted at rapidshare,and in the threads,the links are not clickable and a visitor has to copy and paste the links in addressbar there are many many sites like that even if the are anonymous webmasters,why is their domain not banned. Even google doesn't say anything about that site(This site may harm your computer will be there in google search,when illegal sites are there as a result)
I am not sure if it is covered in the ICANN that you can not have a domain associated with illegal warez. I know if they registered at Godaddy and you complain about the warez to godaddy. Godaddy will take the domain away. I am not sure about other registars. As for why they are not banned. Depends on what you mean by Banned, from where and when. You talking about Billions of web pages with only really each other to report a wrong doing. Just cause it's illegal doesn't mean they will find it right off the ball. Also, if they are hosting the USA, and a user submits warez and the site isn't dedicated to warez then according to the DMCA then the copyright owner will have to follow procedures set by the website to alert the website of the offending page and have them take it down. If not then the copyright owner can sue. Now that only depends on if your site isn't geared towards warez anyhow and that a user submitted the links. You can try to defend it as you want and your going to do what you want, but it is still illegal and let the courts really decided if you should go to jail or pay a fine or if you did anything wrong. Copyright violations and warez is alive and well on the internet.

I think posting that link a second time is unnecessary and somewhat advertising warez. I also think that the answer has been answered quite clearly in different forms. It's illegal, they will get caught out eventually. like exodus says, there are tons of illegal websites they can't all be found at once. Some use hard domain names. Some of them cover up their tracks by putting a normal website in place and operating "underground" style. By carefully selected members, etc. But either way you look at it. It's illegal, don't try it, otherwise you'll get caught soon enough.
Yes it is illegal if you link to it and live in the states.... and warez suck! lol... Anyway, honestly speaking, get a hosting where warez linking is allowed... like PM aqnshosting in DP and tell him that godsofchaos referred you for a hosting package and he will take care of you and keep you safe. Don't risk it. It's not safe at all. You can still be prosecuted and so can the host for openly knowing what was going on. But, it's your choice.
Look at it this way........ you are obviously starting out in the web trying to make money like the rest of us. So let say you develop something or write some great content for something and then people steal it. Would you be pissed off? Would you potenitally lose money?? The obvious answer is yes...... So the simple response to your post is DONT DO WAREZ (or condon them by placing links).... FULL STOP!! Do drugs instead
Warez linking is not illegal.. Just host your site on a offshore server and you will be good. Only way your gonna get caught is hosting warez on ur server in the US..
It's illegal. It's supplying links to illegal content, no matter whether it offshore or not. Theres going be more ways than one to get charged. You can talk about the subject of wares, etc. But you can't tell people how to get it and where from, etc. Looks at the replies to this thread. Most of them are telling you it's illegal. I don't know why people even think about going into the warez scene. Soon enough your going get soppy on your excuses to the law, etc and you will be in front of a judge before you can say "Adobe Cracked!"
you will not get in trouble because you are not hosting the files yourself. however of you host(where the files are hosted) doesn;t allow warez then its a risk. but either way its illegal. i do it too
He can get in trouble and you can. It's supplying links to illegal content, which is an offence. But i'm done with this thread and it's getting rather dull. All i'm going say now is your better off going to see someone who knows the law in full, such as a lawyer who will then tell you what your liable to, etc etc.
