There are a few domain privacy sites out there, like WhoisGuard for example. I know that ICANN is ok with these companies as they are made to forward the information to the proper owner and of course give up information to authorities. However, is there anything 'legally' stopping someone from starting their own domain privacy company? Assuming that they use the same basic principals in terms of what is done with the users information? In theory it could be quite profitable, you could charge lower rates and the market isn't anywhere near saturated.
Just think why the market is not saturated. Well this is how it works if someone signs up for a domain they get domain privacy free or will pay for domain privacy from the provider. Now the domain register knows the name and address of the purchaser so it can provide its own privacy service.If you provide this service the domain owner needs to change his or her domain name to your company address which just may not go down with the domain provider to well and therefore the domain in question could get suspended. The domain suspended may not be from ICANN but the provider and can they do it? Yes they can. Question to you sir are you a Satanist?

Nope. But. There is a but somewhere. But you might take the flak like Spamhaus blocking your ISP for not shutting down a domain due to spam, a trademark holder suing you instead of the domain's registrant for trademark infringement, etc. YMMV.
