Hello I ve ran a contest for logo on this forum. One interested me : http://forums.digitalpoint.com/showthread.php?t=975051&page=2 but it s clearly a rubick s cube. The logo is for a one man computing company. Do you think there s any legal risk with this cube design? tks
There is definitely a legal risk. The company that sells the original Rubik's Cube, Seven Towns Limited, holds a registered trademark on the design of the cube and has at times pursued action based on its trademark. However, since the colors in the logo are different than the Rubik's Cube, you are probably OK. Of course, there is still a legal risk.
thanks for you answer, my guess is that I am not selling toys as well, just local computing services and that the worst case scenario would be to remove my logo.... Would that make sense?
True, since you aren't profiting directly, the most likely demand would just be to remove that element of your logo. If it is primarily for use on your website, removal is a cheap and easy fix. If the logo is on your letterhead, envelopes, billing statements, 4-color brochures, your sign outside your building, etc... even "just" removing the logo can be quite an expense.
