Ripped Tutorial, Ripped Name

Hey there - One of my affililiates (Photoshop Star) emailed me to let me know that a new Photoshop Site has recently ripped a tutorial of mine as well as their name.

    Rip: http://www.photoshopstar.tym.sk/nalepka.html
    Original: http://mintyferret.com/photoshop/web-20-badge-tutorial/

Although this hasn't happened to me before, I know I'll need to contact the host, let them know of the infringement, and hopefully they'll take them down. Now how do I go about finding out who the host is?

    Thanks!

Could anyone help? I've looked up the whois info but I'm not sure what to do with it / how to contact his host.

According to the whois, the nameservers point to ignum.cz and ignum.com, I would try: http://ignum.cz.

I don't know what language that is, but it looks like it might be a hosting company.

Thanks a bunch, I'll give them a try -- I'm worried about them not understanding english though, and I don't speak any czech at all. Would copyright laws apply the same way there as here?

First I have to say this is very insulting to me as a Czech that this thing even happened and I'm willing to help you with eventual translation of communication.

But before doing anything you'd better ask yourself : "Is it worth it?" Czech Republic + Slovakia is altogether +- 15 million people - and that's pretty much everyone who can understand that tutorials, not to mention ugly site design and slow free hosting. :)

These guys are probably just too lame to make something on their own, they can be expected to get shut down eventually.

EDIT : Now I see that they're ripping other people's tutors as well, guess not a single one there is genuinely theirs. Not very nice

Hi Funin, thanks for the offer :) I have contacted their nameservers above, and they have pointed me (in english) to the actual people hosting the site. I've emailed them and I'm currently waiting for a response. It looks like they are probably able to communicate in english so I'm fine for the time being!

I am going to try to get them down, since they're not only ripping my tutorial (and taking the exact same images as me, etc. etc. I can't tell if they've ciopied my text verbatim and have just translated it [have they?] but I wouldn't put it past them) but ripping other sites as well.

Yes, there's no worry, even people in central/eastern Europe can speak English, at least on a basic level.

Yup, that's just the thing they've done! Word by word, just translated it.

OK good luck with that, let me know if you still need a translator ;)

Turns out the people with the nameservers aren't their hosting company. They did point me to the url of their hosting company though.

I sent them an email a while ago but haven't heard a reply yet. I'm wondering if it's because they can't read english - Funin would you mind just translating this into Czech? I don't want to ask you to translate too much because you really are doing me such a favor!

    Subject: Copyright Infringement

I have contacted you earlier in regards to a site you are hosting. This particular site has infringed upon my copyright and I would appreciate you discontinuing your services to them. Otherwise I may be forced to pursue legal action. I have attached the message I sent below in english, please respond and let me know if you are unable to read english.

    Thanks!

    Oukey here you are :

I really like translating so there's no problem :D

Don't forget to change your charset in email client to Windows-1250 (Central Europe) or better yet, UTF-8. Otherwise the Czech characters (ěščř etc. :D) may get really screwed.

PS: Don't u think our language is just beautiful? ;)

Funin thank you SO MUCH! My site is currently suspended because my host was being rude (he had to move servers, so he suspended all sites on the old server to 'get our attention' so we would change our DNS), but the second it's back online I'll send that off and tell you how it goes.

    Thanks!

Well, how did that work? Judging by the first look, no too great. The rip site has growed into a forum and all the tutorials are there. Come on, we gotta do something about this.

    Looking into it now,

They have grown, but his tutorials no longer ripped.
They have remade it themselves, which cannot be concluded as a direct rip.
