I purchased software from pennyauctionscript.com (formally swoopoclone.com), long story short, the software is defective and after researching it, a lot of people have been ripped off by them. My first question is how can I find their mailing/physical address other than paying an attorney. Also, what legal recourse do I have. Thank you
Honest answer: Charge back on your credit card and chalk it up to experience. If you really want to try to sue, their domain is whois protected by Godaddy. http://whois.domaintools.com/pennyauctionscript.com http://www.domainsbyproxy.com/popup/subpoenapolicies.aspx
I did a charge back and was denied because I waited too long. I know I should be talking to an attorney, but would I have to file a civil case in AZ to subpoena them?
Standard "I'm not an attorney" clause here Honest answer: I don't know. Here's what I'm looking at: http://www.justice.gov/marshals/process/civil-subpoena.htm I would say it would have to be served in AZ to get a response out of Godaddy but I don't know if an actual suit would have to be filed first.
you should be? no attor is going to talk to you about you getting ripped off online...atty's are out making big $$ from car accidents...no one care's about you and your little software ripoff. grow up, learn, move on with your life in a more productive manner.
